5th Circuit will not revive Walmart’s lawsuit against the DOJ for opioid prescribing practices

A federal appeals court on Wednesday declined to reanimate a lawsuit Walmart filed against the US Department of Justice over federal law regulating opioid prescribing practices.

Walmart sued the government last year, urging the US District Court for the Eastern District of Texas to resolve pharmacists’ obligations to refuse to fill out suspicious prescriptions under the Controlled Substance Act. In the complaint, Walmart said its pharmacists could be viewed as wrong medical judgment by doctors if they refuse to fill out prescriptions and accused the government of having “unwritten expectations” about how the company and other pharmacies deal with opioid drugs. Avoid prescriptions.
