Embarrassment man charged for Hoyt Lakes drug overdose death – Duluth News Tribune

HOYT LAKES — Samuel Tristan Rogers, 24, of Embarrass, has been charged with third-degree homicide for allegedly supplying the drugs that led to the death of Joshua Gams, of Hoyt Lakes.

Gams was found dead in his home the morning of March 5. Officers found a sheet of aluminum foil with some burnt residue and a pen tube on the scene. Both later tested positive for heroin and fentanyl, according to the criminal complaint. A medical examiner attributed Gams’ death to a fentanyl overdose.

A search of Gam’s cellphone showed him in contact with Rogers and arranging to buy drugs the afternoon before he died.

A search warrant was issued for the Eveleth residence where Rogers had been staying, where officers found 1.56 grams of heroin with packaging materials and $539 in cash.

A criminal complaint said Rogers admitted to selling and using heroin, as well as engaging in the personal use of methamphetamine. During questioning, Rogers reportedly admitted using heroin with Gams the night of his death, falling asleep and then waking up to find him dead.
